MoonSays · Terms of Use
These terms apply when you use the MoonSays Android app ("the app"). By using it, you agree to them. MoonSays is made by Kuntay Erkuş, an individual developer based in İzmir, Turkey, publishing as Grio Works ("we", "us"). Contact: info@grio.works.
For planning and reflection. Not a guarantee or professional advice.
1. What MoonSays does, and doesn't
MoonSays helps you pick a time for something you've already decided to do. For a task you choose, it gives a day, a time window and a score.
- Sky positions are calculated on your phone from JPL's DE441 planetary ephemeris. MoonSays isn't affiliated with NASA or JPL.
- The rules that connect those positions to everyday tasks come from traditional electional astrology and moon-calendar lore. They're beliefs, not scientific findings, and they can be wrong.
- The app doesn't predict events or outcomes and doesn't tell you whether to do something. It only suggests timing.
- Health, money and legal decisions are out of scope. For those, talk to a qualified professional.
- There's no human advisor in the app. Scores and explanations are generated by a fixed rule set and sentence templates, and they can contain mistakes.
- You're responsible for your decisions and what comes of them.
2. Who can use it
You must be at least 13 to use MoonSays. If you're under 18 (or under the age of majority where you live), use the app and make purchases only with a parent's or guardian's permission.
3. Your data
The app doesn't need an account. Most of your data is stored only on your phone, so it doesn't move to a new phone and is deleted when you uninstall the app. Our Privacy Policy explains what we collect and why.
4. Premium subscriptions
- Premium is an auto-renewing subscription, billed monthly or yearly. The price, billing period and what's included are shown on the purchase screen before you buy, in your local currency.
- Your subscription renews automatically at the end of each period, at the then-current price, until you cancel. If we ever raise the price, Google Play tells you in advance and, where the law requires, asks for your agreement.
- Free trial. If a trial is offered, the purchase screen shows its length and the date it ends. If you don't cancel before it ends, the paid subscription starts and you're charged. We'll remind you before the trial ends.
- How to cancel. Anytime, in Google Play › Payments & subscriptions › Subscriptions, or from the “Manage your subscription in Google Play” link in the app. Cancellation takes effect at the end of the current period; you keep Premium until then.
- Payments and refunds are handled by Google Play under its terms and refund policy. To ask for a refund, use Google Play. You can also write to us and we'll help where we can.
- Nothing in these terms limits rights you have under consumer law where you live (see section 7).
5. Fair use
Don't use the app for anything illegal. Don't reverse-engineer it, scrape it, get around its security, or abuse its cloud services. The app's design, text, rule set and software belong to us and are protected by intellectual property law. You may use the app on your devices for your own, non-commercial purposes; this right is personal and can't be transferred. Share cards you create are yours to share.
6. No warranty
We work hard to make MoonSays reliable, but we provide it "as is" and "as available". To the extent the law allows, we don't promise that the app's suggestions are correct or suitable for any purpose, or that the app will always work without interruption.
7. Liability, and your consumer rights
To the extent the law allows, we aren't liable for losses that come from decisions you make based on the app, or for indirect or consequential losses. Where liability can be limited, our total liability to you is limited to the amount you paid for MoonSays in the 12 months before the claim.
These limits don't apply to liability that can't legally be limited, such as for our gross negligence or intentional misconduct. They also don't affect your statutory rights. In particular:
- Australia: our services come with guarantees that can't be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those guarantees.
- New Zealand: nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
- Canada and the United States: some provinces and states don't allow certain warranty exclusions or liability limits, so some of the above may not apply to you.
8. Changes and ending the service
We may update the app, its rule set and these terms. If a change matters, we'll tell you in the app before it takes effect. If you keep using the app after that, the new terms apply; if you don't agree, stop using the app and cancel any subscription. If we ever shut MoonSays down, we'll give notice in the app, and Google Play's rules for active subscriptions apply.
9. Law and disputes
These terms are governed by the laws of Turkey, without depriving you of the protection of mandatory consumer laws in the country where you live. You can bring a claim in the courts where you live, if your local law allows. Before going to court, please write to us; most problems are quickest to fix by email.
